BYD Prevails in Defamation Case, Defamatory Media Ordered to Pay $280K

BYD’s “Clear and Bright Operation” continues.

On September 2, BYD’s legal department issued an announcement regarding the infringement case involving the self-media account “Longzhu-Jiche” and its related accounts. The release stated:

The self-media account “Longzhu-Jiche” and its related accounts were found to have engaged in infringement in the first-instance judgment due to long-term publication of a large amount of false, insulting, and defamatory information about BYD. The court ordered the defendant to: issue a formal apology, delete the infringing statements, and compensate BYD for economic losses totaling 2.0187 million yuan. The second-instance judgment upheld the original ruling.

Recently, through court enforcement, the compensation amount of 2.0187 million yuan has been executed and received. At the same time, the actual controller of the self-media account “Longzhu-Jiche” and its related accounts has provided BYD with a written apology.

The mentioned “infringement case” lasted two years and has now officially come to a close.

According to public information, “Longzhu-Jiche” had previously published multiple posts detrimental to BYD, such as “The BYD Song’s wheels become misaligned while driving—its chopstick suspension is indeed ‘brave'” and “The BYD Tang, known as a ‘road tank,’ had its B-pillar completely destroyed in a same-direction high-speed rear-end collision.” These posts received high numbers of likes and comments.

In July 2023, BYD’s legal department formally filed a lawsuit against the Weibo user “Longzhu-Jiche.” BYD stated at the time that the account had “long published a large amount of false information, maliciously defaming, belittling, and insulting BYD, causing serious damage to BYD’s brand reputation.”

In December 2024, the first-instance judgment found the defendant guilty of infringing upon BYD’s reputation rights, ordering the deletion of the infringing statements, a formal apology, and compensation for economic losses totaling 2.0187 million yuan. The second-instance judgment upheld the original ruling.

On December 3, 2023, BYD released an announcement stating that there would be rewards for reporting, with the highest reward reaching 5 million yuan, and it would be valid for a long term.

The “Longzhu-Jiche” case is just one part of BYD’s series of actions against black public relations. BYD launched the “Clear and Bright Operation” on December 28, 2021, aimed at purifying the online environment and combating malicious acts of black public relations.

On June 1, 2022, BYD increased the reward range for whistleblowers from the original 50,000 to 1 million yuan to 50,000 to 5 million yuan. In December 2023, BYD announced that this reward policy would be long-term, continuing the fight against online black public relations.

With the compensation amount executed and the written apology from the infringing party, this case has finally concluded. However, BYD’s “Clear and Bright Operation” continues.
